Looks like all Palm or anyone else has to do with is is allow for their versions of multitouch to be executed with "a pointing device" other than a fingertip, and just call it "Multipoint" or some such.
Simple enough - and that sort of technology can include fingers, as it's an evolution of what exists, not a replication...
Then again, AAPL might still sue whoever for whatever if someone encroaches on their brainless interface concoctions.

I don't know US patent law, but Bruce Tognazzini "invented" the pinching method back in the 90's when he worked with Sun. The effect can be seen in his 1996 book Tog on Software Design. He sure didn't have any prototype or detailed description of it, so I don't know.

At number 17. The idea is not being stolen. The patent is about any property/device/product that replicates the technology being used in the device/property/product. Not the property/device/product itself. In a way this is good because it will stimulate and force palm and the rest to find (hopefully) a better way to either implement and improve this technology, or force them to come up with their own technology to be used in future products.
Also any company can use the technology apple patented as long as they pay apple its share.

Everyone relax, Apple may think they have thee patent but they only have "A" patent. There are many forms of multi-touch, Apple purchased a company that made "A" form of multi-touch, it is not the same multi-touch on the Palm Pre. The touch screen on the Palm Pre was designed by Cypress Semiconductor, they have been making Projected Capacitance multi-touch screens for years. The Pre uses a Projected Capacitance screen the iphone does not.

What bugs me is that Apple did not invent this. They just patented it. They will also not license it to competitors to their advantage. As I said earlier, it is holding back everyone. I just hope that Nikolay is right when he mentions the heuristics aspect to the patent.

I haven't read the full patent so don't have all the facts, but based on the abstract, which sounds so vague, it could be applied to pretty much any aspect of or implementation of a multi touch input device.
Heuristics doesn't help the situation much either, as you would have to define that term in relation to interpreting the inputs from a multi touch surface. This again could be any software algorithm that can read the data from a multi touch device and produce a useable output. So again, pretty much any implementation.
I am also surprised that apple were granted a patent for an idea that exists in the public domain. Think of all the times you have seen multi touch in films?
I think the problem may lie in the fact that this idea may not been patented before and apple got there first, but it strikes me that the patent office are being complacent in granting it in the first place.

The patent is for the technology on portable devices. No one implemented this technology in this form before apple. Microsoft's surface and Jeff Han's products are amazing, but they are not portable and require complex IR systems. Now that it is around, it may seem obvious, but this obviousness did not promote any other company to release a similar product until Apple did. Ideas and special effects in movies are one thing, but to make the hardware and software work in a volume production is challenging. Why do all of these new devices have the same icon and dock layout? There is plenty of room for innovation.

thats the same reason why I have a serious discomfort with WACOM and its monopoly Patent on passive pen inputs, Tablet PC would be much more common all over the place and you would get decent pens not this crappy plastic shit for 40 usd they are offering but that seems to be the way to go in niche markets in which also the iPhone still is, even if its a pretty lucrative one to capitalize on.

Palm doesn't have to necessarily invalidate this patent (due to prior art or obviousness) or even prove that they don't infringe. The way this works more often than not is that if Apple files suit (or makes threats) the lawyers get together in a room and Palm says "I'm not saying we're infringing but if you go there then we're going to look carefully through our portfolio of X hundred of mobile device patents and find where you are undoubtedly infringing on our IP". (My quick USPTO search showed 317 patents assigned to Palm).
One outcome of this (for bigger cos -- not trolls), is that they come to terms and cross license their portfolios and everyone walks away happy (more or less).
Not saying it's a good thing, but it is the way it tends to work. BTW, neither Apple or Palm have reputations for being particularly litigious.

I HATE patents like this. They are so vague. I am sure there were easily 6 companies working on ways to "use multiple fingers" to interact with a "personal computing" device. Apple just got their paperwork processed first. I am all for protecting IP but Apple can't hide behind patents to eliminate competition. My friend who works on the iPhone team is really excited about the Palm Pre. He wants competition to spur Apple in to making a better product. Let's hope that this "patent" and "IP" doesn't inhibit revolutionary innovations. (There is one company in my industry who has a patent for something totally obvious, and gets about 50% of their annual revenue from settlements related to the patent. They have essentially stopped innovating and product development in order to collect money to "protect their IP")

Both MediaLab at MIT and Xerox PARC had technologies and patents based on gestural interfaces, both in contact with the screen, and in space. I saw some of them demo'd back in 1990. Do a quick search on Siggraph archives. The only viable aspect of Apple's patent would have to be very granular aspects of mapping multi finger movments to specific commands in very specific apps. Not foundation patents, as they seem to think.

Looking at a summary of the patent, Apple appears to be claiming a right to a multi-touch interface OF ANY SORT used to control a computer through multi-touch presses and gestures.
They didn't think this out too well -- every personal computer since 1985 uses multi-touch gestures to load programs and control a PC through heuristics... multi-touches on multi-button mice (complete with gestures), and keyboards (which are multi-touch whenever you use the Shift, Alt, Control or other keys).
That invalidates the multi-touch claim.
The remaining claim is about touchscreen. Well, touchscreen phones by other vendors predate the iPhone by a decade or more, and since multitouch is a PC-based innovation brough to touchscreens on copy machines, ATMs and other devices over a decade ago, Apple's patent suddenly looks VERY tenuous.

Apple has failed to list a whole body of prior work in mutli touch from the 1980s through the 1990s, of which they are definitely aware because of the personal involvement in some of that work by members of the iPhone UI team. This will torpedo this claim.

I have an iphone, and I am also a developer. I had a palm treo before this. The only thing the iphone can do natively that my 4 year old treo could'nt, is wifi and gps. I do like it now, but I and millions of other business and IT professionals managed without it just fine. My Palm treo even had the ability to use touch signals with zooming and scrolling abilities using programs that supported it. One that did was a file reader called "Picsel Proviewer" do a search on youtube for demos. Most of the demos are on windows mobile devices but it did work on Palm OS treos as well. Actually apple probably stole the tech from these guys. All the while you guys were probably having wet dreams about your new Razor.
I am looking forward to the Palm Pre even if they pay Crapple money to license the stolen technology.... its better then the iphone simply because it runs on Linux.

Do you really think the OS on the iphone is better then a full running linux OS which is what the Palm Pre runs on?... do you even understand the possiblities that could bring? They didn't think this out too well -- every personal computer since 1985 uses multi-touch gestures to load programs and control a PC through heuristics... multi-touches on multi-button mice (complete with gestures), and keyboards (which are multi-touch whenever you use the Shift, Alt, Control or other keys).
That invalidates the multi-touch claim.
The remaining claim is about touchscreen. Well, touchscreen phones by other vendors predate the iPhone by a decade or more, and since multitouch is a PC-based innovation brough to touchscreens on copy machines, ATMs and other devices over a decade ago, Apple's patent suddenly looks VERY tenuous.

I have an iphone, and I am also a developer. I had a palm treo before this.
The only thing the iphone can do natively that my 4 year old treo could'nt,
is wifi and gps. I do like it now, but I and millions of other business and
IT professionals managed without it just fine. My Palm treo even had the
ability to use touch signals with zooming and scrolling abilities using
programs that supported it. One that did was a file reader called
"Picsel Proviewer" do a search on youtube for demos. Most of the demos are
on windows mobile devices but it did work on Palm OS treos as well. Actually
apple probably stole the tech from these guys. All the while you guys were
probably having wet dreams about your new Razor.
I am looking forward to the Palm Pre even if they pay Crapple money to license
the stolen technology.... its better then the iphone simply because it runs
on Linux.
My question to dumb asses/crapple fanboys/girls.
Do you really think the OS on the iphone is better then a full running linux OS
which is what the Palm Pre runs on?... do you even understand the possiblities
that could bring? I am talking about all the things like flash support,
copy/paste, native divx support, etc... Yes, I know there are some 3rd party
apps that allow some copy and pasting. Ha...now you fanboys cant say, hey dumb
ass, their are apps that allow copy-paste. Sure if that's what you want to
call it. Also TomTom navigator fully ran on my treo. Iphone doesnt even have
any real offline maps app. Just some that allow you to download sections of
google maps to view offline. In comparison to TomTom...there is no comparison.
I was given this iphone as payment for a job. I had never planned to purchase
one. My treo still works fine and I still use TomTom on it all the time.

Apple doesnt beleive in competition at all. That's why their computers only use
certain hardware. If they really believed in competition they would open up
there system for all hardware manufacturers. I can buy the same hardware that
is in your G5 for a fraction of the cost. If a pretty case means that much
to you...then...well that's just sad... oh you can find those too.

Anyone who thinks ONE company can make better products then HUNDREDS of
companies competing to be the best.
